DEFECTIVE PRODUCT LIABILITY CLAIMS

Defective Product - a claim arising from injury caused by a faulty product or service are subject to the doctrine of strict liability (indefensible). In Tort Law, strict liability means that the defendant may be held liable to the claimant even in the absence of any identified fault, the fact that the product is faulty is sufficient to give rise to a claim. An important source of statutory strict liability is the Consumer Protection Act 1987 and Sale of Goods Act 
For a claim to succeed under the Consumer Protection Act, the claimant must show that:

  • there was a defect in the product
  • there was injury or damage to property
  • the injury or damage was caused by the defect

Examples of defects;

  • Faulty electrical goods that result in causing injury or damage to property
  • Defective tools that cause injury
  • Defective parts on cars or machinery than result in injury or damage
  • Poor workmanship when repairing or servicing that results in or causes injury or damage to property
  • Defective toys that cause injury
  • Food poisoning 

There are many reasons why products may cause accidents for example the materials used in the manufacturing process may be defective, the design of the product may be at fault or the packaging in which the product is carried or concealed in may be faulty. 

Manufacturers and service providers must ensure that the products and services they provide are safe, if they are not and they cause injury or damage then they will be liable to pay compensation to the injured party. The Consumer Protection Act 1987 and Sale of Goods Act make it easier for consumers to bring a claim against manufacturers and suppliers of defective products and services.
