SLIP & TRIP ACCIDENTS

Slipping & Tripping Accidents- are common place and happen in many locations. The level of duty of care differs in claims of this type and below is some of the most common scenarios that give rise to these types of claims.

Private / Commercial Property- claims that occur on private property or commercial property (shops, restaurants, garage forecourts etc.) are subject to statutory law Occupiers Liability Act 1957 lawful visitors. The occupier should ensure that the premises are reasonably safe for the purpose. If an accident happens, the question of liability will rest on whether the premises were unsafe. The classic test is whether something presents a reasonably foreseeable risk of injury to persons using the
premises in the manner in which they may be reasonably foreseen to use them.

Roads, Footpaths & Pavements- responsibility for accidents caused in these areas is usually down to the Local Authority (Councils). The general rule with these claims is that the defect must be one inch (28mm) or more in height or depression. However, the location of such a defect can also be an important factor in a claim of this type, depending on the location it may be argued that even though it is an inch or more it is sometimes argued that the claim is not an 'actionable defect' because of its locality. The one inch rule does not necessarily apply to private property because there is higher duty to maintain privately owned property.
