SPORTS INJURY ACCIDENTS

Sporting injuries are deemed to be an inevitable hazard when participating in a contact or semi contact sport and whilst participants consent to a level of contact considered reasonable for that particular sport or recreation in which they participate. Excessive or unreasonable contact or force is negligent and reckless and the view that serious injury is part and parcel of playing your sport is now changing especially with the growth of No Win No Fee litigation.

Injured parties are increasingly exploring the possibility of making a claim for compensation where they have suffered injury due to the negligence or recklessness of others. Those participating in sports and recreational pastimes have a duty care to other participants to exercise reasonable care when participating. Failure in this duty can result in a claim for compensation from an injured person as a consequence.

As far as injuries arising as part of the normal 'rough and tumble' of the game or an accidental or misjudged contact then you must accept this kind of minor contact or injury as part of your participation of your sport or pastime.

Below is a list of examples that may give rise to a No Win No Fee claim;

  • Violent conduct of a competitor
  • Reckless or Malicious conduct of a competitor
  • Defective or unfit playing surfaces or areas
  • Defective or unsafe equipment
  • Insufficient instruction or guidance
  • Insufficient supervision or intervention by referee

It is often those organising or supervising an event or activity that can be held responsible and it is likely that is those organising/ supervising who will be presented with a claim if they fail to exercise a Duty of Care toward those participating.

No longer is it only high profile sportsmen or women who are making claims for sporting injuries. Injuries suffered by amateur sportsmen and athletes are just as bad and debilitating and can lead to pain suffering, loss of earnings and/ or disability.
